Farm Sales and Purchases

Paul Gibney has a farming background, and is an Accredited Business Law and Property Law Specialist. He can assist in farm sales and purchases, and in particular the following:

  • whether any stamp duty concessions or exemptions are available
  • ensuring that water rights or enclosure permits are transferred to the purchaser
  • ensuring that rates and other charges on the property such as Rural Lands Protection Board rates or land tax are cleared at settlement
  • obtaining any information on record regarding stock diseases or chemical residues (the release of this information requires the consent of the owner)
  • negotiating contractual terms and special conditions
  • ensuring that there is road access to the property
  • checking the area of land in each separate title and the overall area
  • advising on which legal entity will acquire the farm, including attending on accountants to discuss
  • advising in relation to the zoning of the land, particularly if a purchaser wants to obtain a building permit and is interested in the possibility of future subdivisions of the land
